Sustainability Declarations
What is the sustainability declaration?
From 1 January 2010, the sustainability declaration is a compulsory checklist that must be completed by the seller when selling a house, townhouse or unit in Queensland. This new Queensland initiative has been legislated and is a requirement under the Building Act 1975.
The new legislation requires that all houses offered for sale in Queensland must display and make available to buyers a copy of their Sustainability Declaration for the property.
The homeowner (seller) may fill in the Sustainability Declaration or a third party may be utilised to assist the homeowner in completing the form. It can be useful to utilise a third party to ensure that the sustainability attributes of your home are documented as completely and accurately as possible.
The Sustainability Declaration identifies the property's environmental and social sustainability features in four key areas – energy, water, accessibility and safety.
The Sustainability Declaration checklist makes it easier for buyers to compare homes that they are considering buying in the areas of energy and water efficiency, accessibility (ie ease of use by people of all ages and abilities) and safety features.
The financial value of these attributes will likely start to become reflected in the resale value of homes and householders will have a greater incentive to invest in improvements to their homes even if they themselves do not plan on living in that home for a long time.
Who should complete a sustainability declaration?
The declaration is designed to be completed by the property owner or a delegated individual. If an owner is unable to complete the form, they can seek help from another person to complete it on their behalf as long as the owner signs it. Where an owner cannot sign the form, a person authorised under a power of attorney or other statutory power may sign the form.
